Momentum Legal Solutions is committed to protecting the privacy of its clients, team, and affiliates. Momentum Legal Solutions collects and uses personal information with the necessary consent of those individuals directly affected by the information and/or as permitted by law, including the principles for the protection of personal information in the course of commercial activity pursuant to the Personal Information Protection and Electronic Documents Act (“PIPEDA”). The type and quantity of data and information collected are limited to what is required to achieve the goal for which the said data and information are collected. 

Momentum Legal Solutions, its principals, and agents are governed by the applicable Rules of Professional Conduct applicable to Lawyers. All information obtained in the course of providing Legal Services and in the course of a Solicitor-Client relationship are confidential.

If you do not consent to the collection, use, disclosure of your personal information in accordance with this Privacy Commitment Notice, do not provide any personal information to Momentum Legal Solutions, its principals or agents. This information may be required by Momentum Legal Solutions to provide legal services.

Collection and Use of Personal Information

Personal information includes information that can identify an individual, with the exception of professional and/or business information used for employment, business and other professional matters. 

Momentum Legal Solutions collects personal information in accordance with the laws, acts and regulations in effect in New Brunswick and Canada and/or with the Consent of the relevant and interested party.ies.

Personal information is gathered from clients and third parties and is required provide legal services in accordance with the firm’s, it’s principals’, agents’ and affiliates’ professional obligations to prevent fraud, money laundering, confirm client’s identity, ensure the absence of conflict of interests, render and collect accounts, gather data regarding legal issues and marketing, respect other practice standards.

Disclosure and Third Parties

Personal information can be disclosed to third parties in accordance with instructions from clients and within the scope of our mandate or when disclosure is required by act, regulation or statute, to receive a payment, or within and employment relationship. The service providers that we retain are not allowed to disclose personal information to third parties.

Storing and Securing Information

Personal information is treated as private and confidential by Momentum Legal Solutions. We take measures to keep the information that we collect safe and secure, including organizational, physical and technical safeguards. The above noted measures vary with the nature of the information gathered. Personal information will be kept for as long as deemed necessary to meet the objective and criteria and/or satisfy any potential legal obligation that Momentum Legal Solutions could have with regards of this information.
